1. Subject and Explanation
As Izmir Port Travel | Güler Vip Tourism Transportation Construction Auto and Car Rental Trade Ltd. Şti (“Agency”), we are highly sensitive to the security of your personal data. As an Agency, we attach great importance to the processing and storage of all kinds of personal data belonging to individuals related to the Agency, including our customers benefiting from our products and services, in accordance with the Law on the Protection of Personal Data No. 6698 (“KVK Law”). With the awareness of this responsibility and in the capacity of “Data Controller” as defined in the KVK Law, our company processes your personal data in the manner and within the limits envisaged by the legislation, together with the agencies we have a web system contract with.
2. Collection, Processing, and Purposes of Processing Personal Data
Your personal data may be collected, either automatically or non-automatically, by our Agency, the agencies we have a web system contract with, or via the internet site, social media platforms, mobile applications, and similar means, orally, in writing, or electronically. The surveys distributed by our Agency after the tour and the information recorded during the purchase transactions of the tour vouchers are stored. Your personal data can be recorded, stored, updated, periodically checked, reorganized, classified, kept for the necessary duration required for the purpose for which they are processed or for the duration specified in the relevant law, shared with public institutions and organizations that our Company works with or is legally obliged to, and/or with third parties, real or legal persons, service providers and suppliers located in Turkey or abroad, and can be processed, including preventing its use.
While carrying out travel agency activities as per the provisions of the Law No. 1618 on Travel Agencies and the Travel Agencies Union, our Agency enters into agreements with third-party supplier companies and makes reservation records for services to be provided in your name. Therefore, it shares the necessary personal data concerning you with third-party supplier companies (such as accommodation companies, airlines, companies providing transportation services by road and sea, car rental companies, insurance companies, transfer personnel, and not limited to the individuals and organizations related to the services provided). Therefore, our Agency may process your personal data with those legally authorized individuals, institutions, and organizations in accordance with our laws, in addition to fulfilling our obligations arising from the legislation to provide you better service, together with our web system agencies and other relevant persons and organizations, as specified in the KVK Law.
3. Method of Collecting Personal Data and Legal Grounds
Your personal data is obtained through any oral, written, or electronic medium in order to be able to provide the products and services offered by the Company within the identified legal framework and to fulfill the Company's contractual and legal obligations completely and accurately. Personal data collected for the stated legal reasons may also be processed and transferred for the purposes mentioned in paragraph (1) in accordance with the conditions and purposes stipulated in Articles 5 and 6 of the KVK Law.
4. Rights of the Personal Data Owner as per Article 11 of the KVK Law
As personal data owners, you, our customers, may send your requests regarding your rights to our Company through the methods regulated below in this Clarification Text, and our Company will respond to the request free of charge within thirty days at the latest, depending on the nature of the request. However, if a fee is foreseen by the Personal Data Protection Authority, the fee as per the determined tariff will be charged by our Agency.
In this context, our customers have the following rights:
- Learn whether personal data is being processed,
- Request information regarding personal data if it has been processed,
- Learn the purpose of processing personal data and whether it is used in accordance with its purpose,
- Be informed about the third parties to whom personal data is transferred within or outside the country,
- Request correction of personal data in case of incomplete or incorrect processing,
- Request deletion or destruction of personal data under the conditions specified in Article 7 of the Law,
- Request notification of the transactions made under Articles 5 and 6 to third parties to whom personal data has been transferred,
- Object to results arising against the person itself, as a result of the analysis of processed data solely through automated systems,
- Request compensation for damages in case of damage due to unlawful processing of personal data.
In accordance with the first paragraph of Article 13 of the KVK Law, you can exercise your rights mentioned above and transmit your relevant request to our Company in writing or through other methods specified by the Personal Data Protection Authority. Since the Personal Data Protection Authority has not specified any method at this moment, you are required to convey your request to our Company in writing, in accordance with the KVK Law. In this context, the channels and methods for delivering your application within the scope of Article 11 of the KVK Law to our Agency are explained below. To exercise the rights stated above, you can personally hand over a signed copy of your request containing necessary identity determining information and explanations regarding which right you wish to exercise under Article 11 of the KVK Law to “Kazım Dirik Mah. Mustafa Kemal Cad. No:110 K:1 BORNOVA / İzmir / Turkey,” or you may send it via notary or other methods specified in the KVK Law, or you can send the form with a secure electronic signature to info@izmirporttravel.com.
This Clarification Text is an annex and integral part of all service contracts you have signed with our Agency and the Web System Agencies on behalf of our Agency and your service requests.
When a reservation is created and you are included with the attached participants, we will assume that you accept to be informed by Izmir Port Travel regarding campaigns and consent to the processing of your data for this purpose.
